Patient Consent and Who Owns Medical Records

During the Conference Committee for the 2012 HHS omnibus bill, Rep. Jim Abeler and Sen. David Hann held an extended discussion on the privacy issues of the proposed bill. The hospital and health care systems opposed the language. CCHF praised it but said it didn't go far enough. In the end, a legislative study of audit procedures was enacted. The study results are due in February 2013. Testifiers from the MN Hospital Association and Fairview Health Care System testify that medical records are routinely accessed and used for non-treatment purposes without patient consent.
