Deadly Weaknesses of Obamacare

June 4, 2013

Imagine the end of Obamacare. It is more than possible. The law has an Achilles’ heel of mammoth proportions. I looked up the meaning of the term “Achilles’ heel”: “An Achilles’ heel is a deadly weakness in spite of overall strength, that can actually or potentially lead to downfall.” Let those words, “deadly weakness” and “lead to downfall” settle with hope over your mental synapses.

Obamacare has a deadly weakness and the opportunity for downfall is real. Do you remember the “Achilles’ heel” story from Greek mythology? For those of you who need the reminder that I did, here goes:

“When Achilles was a baby, it was foretold that he would die young. To prevent his death, his mother Thetis took Achilles to the River Styx, which was supposed to offer powers of invulnerability, and dipped his body into the water. But as Thetis held Achilles by the heel, his heel was not washed over by the water of the magical river. Achilles grew up to be a man of war who survived many great battles. But one day, a poisonous arrow shot at him was lodged in his heel, killing him shortly after.” (Wikipedia)

Likewise, our arrows must be perfected aimed. Our target is the Achilles heel of Obamacare: its national system of health insurance exchanges – the implementation centers for a federal takeover of health care. This system is vulnerable and in big trouble:

  • Little Cash: The national Exchange system is under-funded (HHS Sec. Sebelius is in hot water for trying to raise funds for outreach outside of Congress).

  • Little Cooperation: States are refusing to help fund it (36 states, most recently NM and ID, have said no to setting up state exchanges – the arms of the national exchange).

  • Untested: No one knows if the national IT superstructure with a centralized data hub for transmitting data and dollars will work (it’s never been tried before).

  • IRS Access: The huge centralized federal database that will collect extensive information on individuals will be available to the IRS and its liberal thugs.

But the Obama administration does not intend to roll over and quit. It is raising millions of dollars and marching forward undeterred as though the mere strength of its will is sufficient. But federal officials and Exchange proponents are very worried. The Exchange is not the only the Achilles’ heel of Obamacare. Each Exchange has its own Achilles’ heel. Two of them, in fact. The duo of deadly weaknesses is: 1) enrollment of individuals, and 2) health plan participation. But the more lethal of the two is enrollment of individuals. This is our target.

No one can be forced to enroll in federal Exchange coverage. In fact, no one can be forced to purchase health insurance, period. That was the clear message of the Supreme Court ruling last year. Mandating the purchase of insurance is unconstitutional. And even though you can be forced to pay a penalty-tax (in Roberts’ twisted reasoning), Roberts’ said the tax cannot be so onerous as to be coercive. Thus, the public may choose to refuse to enroll…and with good reasonProblems with federal Exchange coverage include:

  • Expensive: Premiums will be expensive because premiums will be used to fund the exchange infrastructure (including call centers, navigators, in-person assistors, IT infrastructure, website, enrollment, eligibility determinations, etc.) and cover the costs of people with expensive pre-existing conditions.

  • Limited Choices: Choices of health insurance will be limited by government specifications, and doctors and hospitals will be limited through health plan’s “narrow networks” offerings and Accountable Care Organizations (ACOs).

  • Privacy Intrusions: A comprehensive national database on exchange coverage recipients, the “Health Insurance Exchange Program,” is being created for the purpose of IRS enforcement of the penalty-tax.

  • Not Private Insurance: Exchange coverage is second-tier “Medicaid for the middle class." You have to apply to the federal government using a federal application.

Read the small print. It’s scary. The Exchange application requires you to sign “under penalty of perjury.” The full force of the federal government could come after you if you make any errors, including the IRS, Homeland Security, HHS, Department of Justice, and Social Security Administration. Furthermore, the application informs you that you must regularly update the government Exchange:

  • I’m signing this application under penalty of perjury, which means I’ve provided true answers to all of the questions to the best of my knowledge. I know that I may be subject to penalties under federal law if I intentionally provide false or untrue information.”

  • “I know that I must tell the health insurance Marketplace if anything changes (and is different than) what I wrote on this application. I can visit or call 1-800-XXX-XXXX to report any changes. I understand that a change in my information could affect the eligibility for member(s) of my household.”

Exchange advocates are scared. Some say it keeps them up at night. So millions of dollars will be spent in an attempt to get us all to buy into the “marketplace” illusion of Obamacare. With an October 1, deadline for enrollment to begin, the big sell is almost upon us. It’ll be like an election year. Advertising will be springing up everywhere. Minnesota has a $7.9 million marketing and outreach budget. Illinois has allotted $30 - $35 million. California plans to spend $290 million.

The Robert Wood Johnson Foundation, a long-time proponent of single-payer health care, has already donated $14 million to Enroll America, Obama’s exchange enrollment team. Secretary Sebelius is in trouble with Congress for desperately trying to round up even more cash for Enroll America’s efforts to corral American into the Obamacare system.

We can’t out-spend them – and we don’t have to. We have to out-think them.
