Don’t “Fix” (Expand) Obamacare

Republicans must ignore bad advice. Liberal media, government officials, Democrats, and ACA proponents say Republicans must soon “fix” (expand) Obamacare.

 
At issue is the King vs. Burwell lawsuit against the IRS issuing premium subsidies to those who enroll in Obamacare through the federal exchange, Healthcare.gov. The Affordable Care Act (ACA) only allows subsidies through state-based exchanges (13 states and D.C.). Last year, 85% of Obamacare enrollees got a taxpayer-funded premium subsidy, with 4.6 million getting one through the federal exchange.
 
If the Supreme Court rules in favor of King this June after arguments are heard March 4th – a high possibility – the IRS will be required to follow the ACA as written. The 4.6 million who should have never gotten a subsidy will lose it, making their Obamacare coverage more unaffordable than it is with today’s high deductibles, copays, coinsurance and narrow networks.
 
The liberal media is engaged in baseless fear mongering. They claim people will be left without care. However, non-profit hospitals will still provide charity care. Emergency rooms must still take all-comers. Those who meet the ACA’s “affordability” exemption can purchase inexpensive catastrophic coverage. A new rule recently reauthorized state high-risk pools for people with pre-existing conditions (PoliticoPro, 1/6/15).
 
Furthermore, many of the 4.6 million won’t need care. And those who need care may find it cheaper without Obamacare (no deductible, no copay). Modern Healthcare reports many Obamacare enrollees already use free clinics rather than pay for care.
 
Per the Huffington Post, former GOP Senate Majority Leader Trent Lott encourages Republicans “to work on a technical fix to the Affordable Care Act to ensure that those purchasing coverage on federally run exchanges would continue receiving subsidies.”
 
This is bad advice.
 
There are six reasons why Congress and States must refuse to help Obama if SCOTUS says the ACA must be followed exactly as written (Sources: CCHF and Cato):  
  • Authorizing Obama’s illegal subsidies expands Obamacare.
  • Setting up more state-based exchanges and legalizing Obama’s illegal subsidies (expanding Obamacare) makes repeal more difficult.
  • Availability of subsidies in the 36-37 states without a state exchange makes 57 million individuals and employers subject to ACA mandates and penalties.
  • Expanding Obamacare increases federal/state spending, taxes, and deficits.
  • Expanding Obamacare rewards the administration’s illegal behavior.
  • Expanding Obamacare sets a damaging precedent of the President imposing illegal taxes and Congress ratifying the President’s illegal behavior.
 
 
We’ll work to help Republicans understand that a vote to “fix” Obamacare by legalizing today’s illegal subsidies is a vote to expand Obamacare into permanency.
 
The only way to fix Obamacare is to REPEAL it.
